In a personal injury lawsuit, the main factor is whether you’re able to prove your accident and resulting were directly caused by the negligence of another party. To do this, certain elements must be present in your case. These include:

Duty of Care: The other party involved in your accident must have owed you a duty of care to ensure your safety. They had an obligation to act in a reasonably careful manner that would avoid causing your harm. For instance, motorists have to drive with care to avoid injuring or killing pedestrians, passengers, and other motorists sharing the roadway.

Breach of Duty: The next element is that the at-fault party breached the duty of care by failing to exercise reasonable care. A breach of duty might involve negligent or reckless behavior that’s different from the way a reasonably careful person would have acted under similar circumstances. This may be in terms of the at-fault party driving under the influence of alcohol or texting while driving.

Causation: This element requires that the legal cause of the injury or death was the action of failure to act of the at-fault party. However, the other party does not have to be solely responsible for the accident to prove causation. The main requirement is to show that the party’s negligence directly contributed to the accident.

In this case, the 2-year deadline begins when the victims discovered or should have reasonably discovered that he/she was injured.

There are also cases where the statute of limitations may be suspended or tolled for some time:

  • If the victim is a minor, the statute of limitations will begin upon his/her 18th birthday
  • If the victim is found to be mentally incapacitated at the time of the injury, the court will toll the statute of limitations until the victim is deemed to be no longer disabled.
