Unintimidated by Insurance Companies

Did you know that insurance companies will employ all sorts of tactics to minimize the amount it has to pay or deny a claim after an accident? The claim representative might sound compassionate and friendly, but everything they do is designed to manipulate you into accepting a low settlement offer. And this makes sense because the insurance company cares about their profits. But does it make sense when it’s all at the expense of the injured victim and his loved ones? At Las Vegas Personal Injury Attorney Law Firm, we don’t care about the insurance company’s profits. Our focus is on fighting for recovering family victims and their families. We protect our clients from high-pressure insurance adjusters who are ready to keep pushing them around.

Don’t fight off insurance companies on your own. With huge medical bills and a lack of in-depth understanding of insurance language, it can be easy to accept a lowball offer or give up the fight altogether. What’s more, insurance companies are resourceful and often have a team of lawyers working for them. You need a good personal injury attorney to level the playing field. At Las Vegas Personal Injury Attorney Law Firm, we have a network of investigators, medical specialists, and expert witnesses that we work with to prove your case and maximize its value.  Our attorneys will dive into the background of your case and explore every legal avenue available to help you obtain the resource you need for your recovery. It costs you nothing to get our opinion and weigh in your options. Let us put our vast resources and decades of experience to work for you.

Frequently asked questions

The ultimate question is: How much is my personal injury case worth? It’s a simple question, with a simple answer – but it can be complicated to get to that simple answer. It requires hard work and dedication, an in-depth understanding of the law, years of experience, and a thorough understanding of the tactics that insurance companies employ to try to avoid making payments to accident victims. Every case is different, and recovery will depend on the extent of financial losses and physical and mental suffering.

At Las Vegas Personal Injury Attorney Law Firm, we understand that no amount of money can change the situation, but compensation can set you and your family on the road to recovery. A personal injury claim can help you recover:

  • Lost wages
  • Past, present and future medical expenses
  • Loss of earning capacity
  • Rehabilitation
  • Medical assistive equipment
  • Cost of a caregiver
  • Property damage

You may also be entitled to additional non-economic damages, such as:

  • Emotional anguish
  • Pain and suffering
  • Disfigurement
  • Loss of companionship
  • Loss of consortium
  • Loss of enjoyment of life

Our experience as personal injury attorneys in Las Vegas has provided us with the knowledge and skills needed to assess a victim’s claim and determine the total losses suffered due to the accident. Then, based on our findings, we will explore every legal avenue available to help you recover the maximum compensation that will help you recover from your injury and losses.

In a personal injury lawsuit, the main factor is whether you’re able to prove your accident and resulting were directly caused by the negligence of another party. To do this, certain elements must be present in your case. These include:

Duty of Care: The other party involved in your accident must have owed you a duty of care to ensure your safety. They had an obligation to act in a reasonably careful manner that would avoid causing your harm. For instance, motorists have to drive with care to avoid injuring or killing pedestrians, passengers, and other motorists sharing the roadway.

Breach of Duty: The next element is that the at-fault party breached the duty of care by failing to exercise reasonable care. A breach of duty might involve negligent or reckless behavior that’s different from the way a reasonably careful person would have acted under similar circumstances. This may be in terms of the at-fault party driving under the influence of alcohol or texting while driving.

Causation: This element requires that the legal cause of the injury or death was the action of failure to act of the at-fault party. However, the other party does not have to be solely responsible for the accident to prove causation. The main requirement is to show that the party’s negligence directly contributed to the accident.

Damages: You must have suffered damages as a result of the injuries or loved one’s death. Damages can be physical, financial, or emotional. Your attorney will gather evidence that details the losses you have experienced after the accident.

If you’ve been injured in an accident caused by another person’s negligence, it’s in your best interest to file a lawsuit an injury lawsuit as soon as possible. If the deadline has passed and you try to file your lawsuit, the court will likely refuse to hear it, no matter how good your legal claim for damages is. In Nevada, a personal injury or wrongful death lawsuit must be filed within two years from the date on which the injury or death occurred, according to Nev. Rev. Stat. § 11.190(4)(e). The statute of limitations for cases of injury from a defective or faulty product is four years. The deadline is even shorter for medical malpractice cases as the victim has one year to file from the date the illness, condition, or disease is discovered.

However, there are certain circumstances that could alter the statute of limitations. The time limit may be extended if the victim did not know that he/she was injured at the time of the accident. The discovery rule may be used to extend the time within which the victim is legally allowed to file a lawsuit. In this case, the 2-year deadline begins when the victims discovered or should have reasonably discovered that he/she was injured.

There are also cases where the statute of limitations may be suspended or tolled for some time:

  • If the victim is a minor, the statute of limitations will begin upon his/her 18th birthday
  • If the victim is found to be mentally incapacitated at the time of the injury, the court will toll the statute of limitations until the victim is deemed to be no longer disabled.
